Welcome to Gamification Labs ! These Terms of Service govern your use of our software and related services. By accessing or using our SaaS product, you agree to comply with and be bound by these terms. Please read them carefully.

Definitions:

• "We", "Us", "Our" refers to Gamification Labs OPC Private Limited.
• "You", "Your", "User" refers to the individual or entity using our SaaS product.
• "SaaS Product " refers to Gamification labs and any related services provided by us.

Use of Our SaaS Product:

• Access: You agree to access and use our SaaS product only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.

Payment and Subscription:

• Fees: Certain features of our SaaS product may require payment of fees. You agree to pay all fees specified when you purchase our services.
• Subscription: Subscription plans are billed on a recurring basis unless canceled. Cancellation terms and details are specified in our billing policies.
• Changes: We reserve the right to modify our fees and billing methods upon notice to you. Continued use of our SaaS product after such changes constitutes your acceptance of the new fees or billing methods.

Intellectual Property:

• Ownership: We retain all rights, title, and interest in and to our SaaS product, including all intellectual property rights.
• User Content: Any content or data uploaded, submitted, or transmitted by you through our SaaS product remains your property. By using our SaaS product, you grant us a non-exclusive, royalty-free license to use, reproduce, and modify your content solely for the purpose of providing our services.

Privacy:

Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using our SaaS product, you consent to our use of your personal information as described in our Privacy Policy.

Limitation of Liability:

• Disclaimer: Our SaaS product is provided on an "as-is" and "as available" basis without warranties of any kind, whether express or implied.
• Limitation: To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of our SaaS product.

Termination:

• Termination: We may suspend or terminate your access to our SaaS product immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
• Effect of Termination: Upon termination, your right to use our SaaS product will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Dispute Resolution:

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of Patna, Bihar, India without regard to its conflict of law provisions.
• Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall be settled by binding arbitration in accordance with the arbitration rules of Patna High Court. The place of arbitration shall be Patna, Bihar, India.

Amendments:

• Changes: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 2 days notice prior to any new terms taking effect.
• Continued Use: By continuing to access or use our SaaS product after any revisions become effective, you agree to be bound by the revised Terms.
